Bullying and harassment are unacceptable workplace behaviours that are very different in legal terms. The difference between the two comes from the legislation that covers each one and protects workers from harm and discrimination. You may know that as part of the Health and Safety at Work Act 1974, employers have a duty to look after the welfare of employees at work. And part of this involves protecting employees against bullying. You may also know that under the Equality Act 2010, employers must protect workers against harassment. Harassment is similar to bullying in terms of behaviour, but, in this case, the behaviour is directed at one or more protected characteristics. So, as a manager, team leader, or employer, you need to know what bullying and harassment are and how to protect employees.
